Terms of Service

Welcome to Connect Cleaner. By accessing or using our platform you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the service. These Terms constitute a legally binding agreement between you and Connect Cleaner.

1. The Platform

Connect Cleaner is a listing and connection platformthat helps clients find independent cleaning professionals ("Cleaners") operating in Ireland, and helps Cleaners find clients in their area. We facilitate the discovery and scheduling of cleaning services but are not a party to the service agreement between clients and Cleaners. We do not act as an employer, agent, or intermediary of any Cleaner.

Connect Cleaner does not process, hold, or intermediate any payments for cleaning services. All service payments are arranged and settled directly between the client and the Cleaner. Our sole source of revenue is a monthly subscription fee paid by Cleaners for access to the platform.

Connect Cleaner is classified as an online platform within the meaning of Article 3(i) of the EU Digital Services Act (Regulation (EU) 2022/2065), and as an information society serviceunder Directive 2000/31/EC (eCommerce Directive), transposed into Irish law by S.I. No. 68/2003. Because the platform does not allow consumers to conclude distance contracts with traders involving payment processing, the trader traceability obligations under DSA Articles 29–32 (Section 4, Chapter III) do not apply.

2. Service Provider Information (eCommerce Directive Art. 5)

In accordance with Article 5 of Directive 2000/31/EC and Regulation 4 of S.I. No. 68/2003, the following information about the service provider is made permanently accessible:

Connect Cleaner is a product operated by LUCKY STUDIOS LTDA, a company incorporated in Brazil. We do not currently maintain a physical establishment within the European Union. An EU representative under GDPR Art. 27 and DSA Art. 13 will be appointed before the platform begins monetised operations targeting EU consumers; until that appointment is published here, you may contact us at the email addresses above for any data protection or content matters.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Irish law to use the platform. Cleaners must hold any licences, permits, or qualifications required by applicable Irish law to provide cleaning services commercially.

4. Service Payments (Between Client and Cleaner)

Connect Cleaner does not process, hold, mediate, or have any involvement in payments for cleaning services. All service payments are made directly between the client and the Cleaner by the means they mutually agree upon (cash, bank transfer, Revolut, or other). Connect Cleaner has no access to, visibility of, and assumes no liability for such payments.

  • Prices shown on the platform are estimates based on the Cleaner's hourly rate and are subject to final agreement between client and Cleaner.
  • Clients and Cleaners are solely responsible for agreeing the final price, payment method, and cancellation terms before the service begins.
  • Connect Cleaner does not issue invoices, receipts, or tax documents for cleaning services. Cleaners are responsible for their own invoicing and tax obligations as independent contractors.

5. Platform Subscription (Cleaner Fee)

Cleaners pay a monthly subscription fee to Connect Cleaner for access to the platform, including client matching, scheduling tools, and profile listing. This subscription is the only commercial relationship between Connect Cleaner and its users.

  • Subscription fees are billed monthly via a third-party payment processor.
  • The subscription grants access to the platform; it does not guarantee a minimum number of bookings or clients.
  • Subscription fees are non-refundable except as required by applicable Irish and EU law.
  • Connect Cleaner may offer a free trial period at its discretion. Trial terms will be communicated at the time of signup.
  • Failure to maintain an active subscription may result in the Cleaner's profile being delisted from search results.

6. Independent Contractor Status

Cleaners on Connect Cleaner operate as independent contractors, not employees of Connect Cleaner or of any client. This classification is consistent with the criteria set out in the Irish Code of Practice for Determining Employment Status (2021, updated October 2024), which incorporates the Supreme Court's five-step framework from Revenue Commissioners v. Karshan (Midlands) Ltd T/A Domino's Pizza [2023] IESC 24.

In particular, Cleaners on Connect Cleaner:

  • Set their own hourly rates, working hours, availability, and service areas
  • Choose which bookings to accept or decline
  • Provide their own equipment, materials, and supplies
  • Are free to work for multiple platforms, agencies, or clients simultaneously
  • Bear their own financial risk (no guaranteed minimum income)
  • Are responsible for their own tax affairs, including Income Tax registration, Class S PRSI contributions, and VAT registration if their turnover exceeds the applicable threshold

Connect Cleaner does not control how, when, or where the cleaning service is performed. The Employment (Miscellaneous Provisions) Act 2018, which governs employer obligations such as banded hours and written terms, does not apply to the relationship between Connect Cleaner and Cleaners.

7. Cleaner Responsibilities

Cleaners using the platform agree to:

  • Provide accurate profile information, including real name, photo, location, and professional qualifications
  • Complete the onboarding process before receiving bookings
  • Deliver services to the standard agreed with the client
  • Maintain appropriate public liability insurance for their cleaning activities
  • Comply with all applicable Irish law as independent contractors, including tax obligations under Revenue Commissioners guidelines
  • Issue their own invoices and manage their own tax declarations
  • Not misrepresent their qualifications, experience, or availability
  • Maintain an active subscription to remain listed on the platform

8. Client Responsibilities

Clients agree to:

  • Provide accurate information about the property and cleaning requirements
  • Ensure the property is accessible at the agreed time
  • Treat Cleaners with respect and professionalism
  • Pay for services as agreed directly with the Cleaner
  • Understand that Connect Cleaner has no involvement in service payments and cannot mediate payment disputes between clients and Cleaners

9. Content Moderation (DSA Arts. 14, 16–17)

In accordance with DSA Article 14, Connect Cleaner publishes its content moderation policies within these Terms. Users may report illegal content or content that violates these Terms via the notice mechanism required by DSA Article 16, by emailing support@connectcleaner.net.

When Connect Cleaner restricts or removes content, or suspends or terminates an account, a statement of reasons will be provided as required by DSA Article 17. This includes the facts, legal or contractual grounds, and available remedies.

10. Ratings & Reviews

Both clients and Cleaners may leave reviews after a completed booking. Reviews must be honest and based on the actual service experience. Connect Cleaner reserves the right to remove reviews that violate these Terms, contain illegal content, or are demonstrably false, in accordance with the content moderation policy described in Section 9.

11. Prohibited Uses

You may not use Connect Cleaner to:

  • Post false, misleading, or fraudulent information
  • Harass, threaten, or discriminate against other users
  • Violate any applicable Irish or EU law, including GDPR and the DSA
  • Attempt to gain unauthorised access to the platform or other users' accounts
  • Use automated tools (bots, scrapers) to extract data from the platform
  • Reproduce, distribute, or commercially exploit platform content without permission
  • Manipulate the platform's interface in ways that constitute dark patterns, in accordance with DSA Article 25

12. Data Protection & Privacy (GDPR)

Your personal data is processed in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation) and our Privacy Policy, which forms part of these Terms. The legal bases for processing are set out in GDPR Article 6(1), primarily:

  • Art. 6(1)(b) — Contract: processing necessary for the performance of the subscription or account agreement
  • Art. 6(1)(f) — Legitimate interests: platform security, fraud prevention, service improvement
  • Art. 6(1)(a) — Consent: optional processing such as marketing communications
  • Art. 6(1)(c) — Legal obligation: where required by law (e.g. tax records, law enforcement requests)

Under GDPR Articles 15–22, you have the right to access, rectify, erase, restrict, port, and object to the processing of your personal data. You also have the right not to be subject to solely automated decision-making (Art. 22). To exercise these rights, visit your profile settings or contact us at privacy@connectcleaner.net.

The supervisory authority for data protection matters is the Irish Data Protection Commission (DPC). You have the right to lodge a complaint with the DPC at any time.

13. Limitation of Liability

Connect Cleaner is a listing and connection platform only. We are not liable for the quality, safety, legality, or any other aspect of services performed by independent Cleaners, nor for any payments, disputes, or agreements made directly between users. Our aggregate liability for any claim arising from use of the platform is limited to the total subscription fees paid by you in the three months preceding the claim, to the extent permitted by Irish law. Nothing in these Terms limits our liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

14. Changes to These Terms

We may update these Terms from time to time. In accordance with DSA Article 14, we will notify registered users by email at least 15 days before material changes take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms. If you do not accept the changes, you may close your account before they take effect.

15. Dispute Resolution

If you have a dispute with Connect Cleaner, we encourage you to contact us first at support@connectcleaner.net so we can attempt to resolve it informally.

For disputes between clients and Cleaners regarding the cleaning service itself, Connect Cleaner is not a party and cannot act as mediator or arbitrator. Such disputes are governed by the agreement between the client and the Cleaner.

Consumers resident in the EU may seek resolution through an Alternative Dispute Resolution (ADR) entity certified under Directive 2013/11/EU (as amended by Directive (EU) 2025/2647). Please note that the EU Online Dispute Resolution (ODR) platform established under Regulation (EU) No 524/2013 was discontinued on 20 July 2025 pursuant to Regulation (EU) 2024/3228 and is no longer available.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, where the service provider (LUCKY STUDIOS LTDA) is established, without prejudice to the mandatory consumer-protection rules of your country of habitual residence.

Consumers resident in the European Union.If you use the platform as a consumer (i.e. outside your trade, business, craft or profession), you benefit from the mandatory protections of the law of your country of habitual residence under Article 6(2) of Regulation (EC) No 593/2008 (Rome I). Nothing in these Terms restricts those rights. You may bring proceedings against us either (a) in the courts of your country of habitual residence, or (b) before the competent courts of São Paulo, Brazil. We may only bring proceedings against a consumer domiciled in the EU in the courts of that consumer's domicile, in accordance with Articles 17–19 of Regulation (EU) No 1215/2012 (Brussels I Recast) where applicable by analogy.

Non-consumer (B2B) disputes.For Cleaners acting in the course of their trade, business or profession, and for any other non-consumer dispute arising out of or in connection with these Terms, the courts of the Judicial District of São Paulo – SP, Brazil, shall have exclusive jurisdiction, to the exclusion of any other forum, however privileged it may be.

Client ↔ Cleaner disputes about the cleaning service itself. Connect Cleaner is not a party to the service contract between client and Cleaner. Those disputes are governed by the agreement between the parties and by the law applicable to that contract, typically the law of the place where the service is performed (Ireland).
